Meet The New Face Of Bernie Sanders’ Revolution

When Sen. Bernie Sanders (I-Vt.) bid farewell to his presidential aspirations at the Democratic National Convention in the summer, he instructed his lefty legions to press on. He would not be occupying the White House, but the change his supporters believed in could still be achieved through persistent pressure on the Democratic Party.

“Our revolution continues,” Sanders declared. “This election is not about, and has never been about, Hillary Clinton, or Donald Trump, or Bernie Sanders or any of the other candidates who sought the presidency … This election is about, and must be about, the needs of the American people.”

Sanders was rejecting the idea that his campaign’s popularity had been due to the unique charismatic power of a 74-year-old Vermonter to entrance the millennial hordes. Instead, Sanders had given voice to a grassroots movement both unsatisfied with the political status quo and resistant to the thuggish white nationalism of Trump, he argued.

The biggest test for the future political viability of the Sanders revolution is playing out in upstate New York, where populist insurgent Zephyr Teachout is taking on former state senator John Faso.  The lobbyist is backed by two billionaire Republican megadonors: Paul Singer and Robert Mercer, who have each plowed more than half a million dollars into a Faso Super PAC. Teachout and Faso are vying for the state’s 19th Congressional district, a significantly rural and working-class stretch of counties between Manhattan and Albany.

Teachout has everything Democratic leaders could ask for in a candidate ― personal charisma, policy acumen and an assload of money. She’s raised over $ 1.6 million for her campaign this year. Her average donation amount in the second quarter of 2016 was about $ 15 ― well below Bernie’s famed $ 27 figure.

As ‘Bernie!’ chants broke into his speech, Sanders countered playfully: ‘That ‘Bernie!’ has now gotta be transferred to Zephyr!’

She’s running in a district that both parties are capable of winning. President Barack Obama carried it twice, but retiring Rep. Chris Gibson (R-N.Y.) has occupied its Congressional seat since the Tea Party wave of 2010.

Teachout is running as a hardline wonk-populist. Her economic platform bashes the North American Free Trade Agreement, calls to bust up cable monopolies and force big banks to lend to small businesses. She invokes former President Franklin Delano Roosevelt’s rural electrification project as the precedent for her plan to expand broadband internet access. Teachout’s book, Corruption In America: From Benjamin Franklin’s Snuff Box To Citizens United, is a serious scholarly take-down of the American campaign finance system. She uses the word “antitrust.”

Her PR effort has been pugnacious. One ad calling to clean up the Hudson River ties Faso to Wall Street financiers and Albany sell-outs. Instead of challenging Faso to a debate, she called on his hedge fund Super PAC donor Singer (she suggested topics including NAFTA, fracking and the effect of climate-change on flooding). Last week, Teachout deployed the biggest weapon in her arsenal, hosting Sanders at a rally in her district.

“There are 435 members in the House of Representatives,” Sanders declared to an enthusiastic crowd. “You are about to elect the most outstanding member. A leader in a time where we need leaders … This race is one of the most important congressional races in America.”

As “Bernie!” chants broke into his speech, Sanders countered playfully: “That ‘Bernie!’ has now gotta be transferred to Zephyr!’”

Teachout held her own as the headlining act, zinging Faso as a lobbyist for payday lenders and fracking pipelines, and touting her debate challenge to Singer. “If you wanna buy a Congressional seat, we wanna know why,” she said. “So far, he hasn’t answered.”

This stuff is all gravy to the American left that hailed Sanders in his primary challenge to Clinton. But Sanders lost, and both he and Teachout recognize there is a lot on the line for the American progressive movement in her race. The electorate is obviously hungry for outsider candidates in 2016, but successful campaigns always involve some cult of personality element ― and it is hard to focus the energy of a nationwide presidential race on individual districts. Teachout trounced her opponents in the Democratic primary, but other Sanders-backed efforts haven’t faired as well. Tim Canova was unable to dethrone former Rep. Debbie Wasserman Schultz (D-Fla.), despite the disastrous headlines she cultivated while running the Democratic National Committee. Sanders proved that a small-dollar-donation fundraising strategy can be competitive at the national level, but can it work in a Congressional district, where the price tag for billionaires is much lower?

Progressives have argued for decades that they can win districts like New York’s 19th by appealing to populist economics and attacking political corruption. That thinking violates the traditional Beltway ideological calculus, where a candidate who supports same-sex marriage and abortion rights can make herself more moderate by supporting federal favors to major corporations. Democrats in swing districts have typically taken this approach. Raise money by going easy on big corporations, and keep Democrats on board with social issues.

It does keep the billionaires off your back. But progressive activists have long noted that it doesn’t work with voters. Democratic candidates in rural districts do indeed take a hit with social conservatives for toeing the party line on abortion and gay rights. But it’s hard to see how they can absolve these perceived sins by binding themselves to big banks and oil companies.

Teachout’s campaign is serving as a real-world test of the progressive counter-strategy. Polling data in the district is thin, but a recent survey conducted by the Democratic Congressional Campaign Committee gave Teachout a 5-point lead among likely voters, with 11 percent undecided. The race will depend on whether Teachout’s lead can hold up during the barrage of Super PAC ads that will hit district in the final weeks of the campaign.

But the benefits for progressives from a Teachout win would be tremendous. Teachout said she wants to serve on the House Agriculture Committee if elected, to help serve local farmers. Through a quirk of history, the Ag Committee also shares jurisdiction over Wall Street trading in derivatives, which would give her a platform to assail the financial establishment ― something Singer and Mercer are no doubt aware of. The similarities between Teachout and Sen. Elizabeth Warren (D-Mass.) aren’t exactly hard to identify ― both are economic populists, law professors and women with a knack for breaking down complex issues into voter-friendly arguments. Warren changed Congress with her election in 2012. Sanders thinks Teachout could do the same in 2016.

“You need a leader who will stand up to the billionaire class and tell them they cannot have it all,” Sanders said. The first step is winning.

Vital Lessons Learned From The Chelsea Bombing From A Chelsea Psychologist

The following post was created for Self-Therapy Month at Techealthiest. This is Part One.

When frightening events like the Chelsea bombing and the additional planting of nine other bombs from New Jersey to New York occur, we have no choice but to create a mental file in which to place our thoughts, feelings and images associated with the attack.

It has to be stored in your memory one way or another.

Those of us who live or work in New York City have been more directly affected by this nerve-shaking attack, but its explosive effects are, without a doubt, far-reaching, as news, commentary and images have been repeatedly catapulted from the media toward our eyes and ears, which essentially forces us to make sense of what happened.

At worst, you’ve been vicariously traumatized by the bombing (or directly traumatized if you were on 23rd Street that Saturday night). The more common reaction among is to be shaken and disturbed in the days following the bombing, followed by a few weeks of talking about the bombing with your social and work circles.

Social media essentially guarantees that you’ll have to grapple with disturbing thoughts about the attack, but for how long will  these thoughts linger in your mind?

This leads me to the question I’ve been pondering since the event occurred: What is considered a “healthy” way to reflect upon the Chelsea bombing way after the event, as well other terror attacks that have occurred (and God forbid might happen again)?

Here are four things to be remembered about the attack that will promote health and personal responsibility.

1) Use the memory of this event to remind you of all that you currently have, most notably things that money can’t buy.

You actually are rich because you have everything you need right now. Dare to be more thankful than you’ve been of late. Let the memory of the terror attack spark a feeling of gratitude toward the people in life who are invested in your happiness AND the people who don’t seem invested in your happiness.

It’s just too easy to lose touch with what matters most. Life can change in a split second. Don’t forget that but it’s not healthy to think about this idea all of the time because it can turn to anxiety if it becomes an obsession.  See this horrible event as a beautiful opportunity to be reminded of all that you have, especially your freedom, friends, health, family or whatever matters most to you.

2) Think twice…three times…a thousand times about the consequences of spreading hatred before you utter a single word.

There are two hugely important points here. First, on a personal level, when you spread hatred, you’re killing the cells in your body. You lose. A part of you dies. The spread of word venom is an artificial way to expand your ego by diminishing others. It certainly makes you depressed and it pushes people away from you, except for people who either are as angry as you are or whose lives are devoid of meaning and are looking for something to believe in.

Second, the expression of hatred on the web can cause real harm to people. There are people out there who feed off of hatred. Keep in mind that social media creates a thunderclap that spreads like wildfire through the web. For people who feel powerless, this is a place to gain a synthetic sense of power. Hatred on social media spreads like cancer, and makes everyone sick.

Please know that if you’re constantly ranting on Facebook about Trump or Clinton or any person or group with whom you have a major problem, most of your “friends” are viewing you as crazy. They probably contemplated defriending you, but they’re either lazy or they don’t want to have to randomly face your scariness in the supermarket or at your next high school reunion. Instead, they’ve subtly unfollowed you and connected your current venomous behavior to a past memory of you being something negative. Please know that I’m referring to the expression of hatred, not anger, the latter of which can often be healthy and productive to express.

3) The collective American attention span is shrinking at an alarming rate. 

The speed at which information travels makes us more likely to be satiated at a faster rate. In other words, you’ve probably been bombarded by news of the bombing so much that you eventually either tune it out completely or you go numb when you hear about it. The danger here is that you’re likely to miss the value inherent in remembering what happened and what could have been.

How do you counter a natural tendency for your emotional reactions toward the Chelsea bombing to become watered down as a result of social media satiation? At minimum, make a reminder to mention the bombing at your next major family, religious or other gathering. Talk about the event in terms of how it affected you and what you now feel thankful for. Another strategy is to find a way to express your thoughts and feelings about the event though a creative modality that you repeat even months after the disturbing event. For example, if you dabble in acrylic art, create a series of paintings over time which serve as an expression of your inner experience of the incident.

4) Crowdsourcing is a weapon against terror.

Yes, social media (and the media in general) spread hatred, false beliefs and dangerous calls to action faster than the world as ever known. How little it takes for an individual to incite violence on the web is scary, but various forms media can also (obviously) be used to spread good and inform people of important developments. Case in point: the capture of Ahmad Khan Rahimi, the Chelsea bomber. Harry Bains had been watching CNN, which allowed him to recognize Rahimi who was sleeping next to Bain’s bar in Linden, New Jersey. This is loosely an example of how crowdsourcing can aid in spreading valuable information to combat terror.

Who knows what the next incident will be? Use the internet as a way to inform people if something suspicious is happening in front of you. You have the loudest megaphone ever created in the form of Twitter and Facebook.

There’s much more to say here, but it’s time to digest and return to this topic soon. This essentially reflects the optimal strategy. Ponder the horrible events that occurred. Learn from it. Vow to appreciate life more at least in the short term. Move on but return to it at a later date. Just don’t forget.

‘Love Hormone’ Oxytocin May Enhance Feelings Of Spirituality

The same hormone that helps mothers bond with their newborns may also enhance feelings of spirituality, a new study suggests.

It’s been called the “love hormone” and the “cuddle chemical,” but doctors and scientists know it as oxytocin, a hormone secreted by the posterior lobe of the pituitary gland during times of love and bonding.

A recent study spearheaded by Duke University social psychologist Patty Van Cappellen found that participants who received doses of oxytocin reported a greater sense of spirituality than those who received a placebo.

“Oxytocin appears to be part of the way our bodies support spiritual beliefs,” Van Cappellen said in a statement.

For research purposes, the study defined spirituality as a sense of connection to a higher power or to the world that gives meaning to people’s lives.

Eighty-three men between the ages of 35 to 64 participated in the study. Each participant received either a dose of oxytocin or a placebo, administered through a nasal spray.

Researchers found that those who received oxytocin were more likely to report feeling that spirituality was important in their lives and that life has meaning and purpose. They were also more likely to give higher ratings to statements like, “All life is interconnected” and “There is a higher plane of consciousness or spirituality that binds all people.”

Participants also listened to a guided meditation, after which those who received oxytocin reported experiencing more positive emotions like awe, gratitude, hope, inspiration, interest, love and serenity than those who received a placebo.

The study’s results held true regardless of whether the participant reported belonging to an organized religion or not, and they remained consistent a week after the hormone and placebo were administered.

Van Cappellen noted that the results of the study could only be applied to men given that the research subjects were all males. Oxytocin produces slightly different results in men and women, she said, and thus further studies should investigate the hormone’s role on women’s spirituality.

Even among men, the effect might not be uniform. The study also showed that oxytocin has a stronger spiritual effect on people with a particular variant of the CD38 gene, which regulates the release of oxytocin from hypothalamic neurons in the brain.

“Spirituality is complex and affected by many factors,” Van Cappellen said. “However, oxytocin does seem to affect how we perceive the world and what we believe.”

But Van Cappellen isn’t alone in her findings. Previous studies have shown oxytocin to have a profound impact on spirituality, as well as generosity, altruism, and empathy. Oxytocin has also been shown to play a role in experiences of spiritual transformation.

But it has a dark side, too.

A 2010 study of Dutch males out of the University of Amsterdam found that male subjects who received a dose of oxytocin were more likely to express ethnocentric prejudice and xenophobia than those who received a placebo.

Luckily, spirituality isn’t bound by hormones alone. It’s how we choose to define our spirituality ― whether as a connection to all creation on our global home or loyalty only to those who look, act and believe as we do ― that makes all the difference.

Maybe it’s just us, but we can’t help but conclude that Crippled America is just about Donald Trump’s intense dislike of the Americans With Disabilities Act. And Jill Stein will spend the first presidential debate “in a private space physically, but her presence will be widely felt,” meaning she’ll be transmitting in Luke Skywalker’s brain to use the force to fire on the thermal exhaust port. This is HUFFPOST HILL for Friday, September 23rd, 2016:

TODAY IN LOOMING GOVERNMENT SHUTDOWNS - This is part of why fall is such a great season. Roberta Rampton: “The White House budget office scheduled a call with U.S government agencies on Friday to plan for a government shutdown in case the U.S. Congress fails to pass a short-term funding bill by a deadline next week. ‘It is our hope that this work will ultimately be unnecessary and that there will be no lapse in appropriations,” a spokeswoman for the White House Office of Management and Budget (OMB) said in a statement. The federal fiscal year ends on Sept. 30 and Congress must pass a spending measure by then to keep the government open.” [Reuters]

PEOPLE AREN’T REALLY FEELING THIS ONE SO MUCH THOUGH – Jonathan Bernstein: “I believe that a government shutdown (one that lasts beyond a couple days or so) only happens when one party really wants it to. That explains the two long shutdowns in 1995-1996, when Speaker Newt Gingrich incorrectly believed that President Bill Clinton would fold once pressure was applied, and the 2013 attempt spearheaded by Senator Ted Cruz to steamroll Barack Obama on the Affordable Care Act.  The logic of shutdowns has proved to be pretty simple. Eventually, the government has to reopen. This means that Republicans in the House and Senate are going to have to come to some agreement with the president. Since everyone involved realizes that, neither side has an incentive to hold out beyond the deadline.” [Bloomberg]

Matt Flegenheimer: “Senator Ted Cruz said on Friday that he would vote for Donald J. Trump for president, two months after Mr. Cruz pointedly declined to endorse his former rival in a speech at the Republican National Convention. ‘After many months of careful consideration, of prayer and searching my own conscience, I have decided that on Election Day, I will vote for the Republican nominee, Donald Trump,’ Mr. Cruz wrote in a statement posted on Facebook. Though Mr. Cruz and his aides had never ruled out an endorsement, many in his orbit had chafed at the prospect of supporting a man who had so viciously attacked the Texas senator during the nominating fight. Among other slights, Mr. Trump questioned Mr. Cruz’s eligibility for the presidency, citing his Canadian birth; seemed to disparage the appearance of Mr. Cruz’s wife, Heidi, in a Twitter post; and insinuated, without evidence, that Mr. Cruz’s father, Rafael, was involved in the assassination of President John F. Kennedy.” [NYT]

OBAMA VETOES 9/11 SAUDI ARABIA BILL - The Obama’s will get tons of kudos for this next year when they visit the mosque they purposely moved near. Jen Bendery “President Barack Obama vetoed legislation on Friday that lets the families of 9/11 victims sue Saudi Arabia for its alleged role in the terrorist attacks. But for the first time in Obama’s presidency, Congress has the votes to overrule him ― and it will next week. Obama issued a lengthy statement as he vetoed the bill, known as the Justice Against Sponsors of Terrorism Act.  The White House has been protesting the bill for months, but even Democratic leaders disagree with Obama on this one. The bill prevents Saudi Arabia and other countries with alleged ties to terrorist groups from invoking their legal immunity in U.S. courts. It overrides the 1976 Foreign Sovereign Immunities Act, which grants immunity to countries that aren’t designated state sponsors of terrorism.” [HuffPost]

Congress is expected to override the veto next week.

NJ LEGISLATURE MULLING CHRISTIE IMPEACHMENT – Brian Thompson: “Key members of the New Jersey Assembly have begun researching whether or not to bring articles of impeachment against Gov. Chris Christie, NBC 4 New York has learned. This follows early testimony in the George Washington Bridge scandal trial, which some Assembly members believe shows the Republican governor had more knowledge of the lane closures in Fort Lee during and after that week in 2013 then he has led the public to believe. One committee chairman who did not want to be named said ‘clearly obstruction of justice’ would be an obvious charge against the governor. The legislator told NBC 4 New York the chances are probably 50-50 that the assembly would pursue impeachment.” [NBC4]

DONALD TRUMP DOESN’T JUST MAKE FUN OF DISABLED PEOPLE - He really puts his money where his mouth is, and that is to be commended. Ben Walsh: “At least eight times over the last 19 years, GOP presidential nominee Donald Trump’s properties have been subject to lawsuits for violating the Americans with Disabilities Act, court records show. Additionally, a federal inspection found ADA violations at one of his properties.  Only once did Trump come close to winning, in a suit that was dismissed at the request of both sides. Five of the cases were settled, while two ended in consent decrees requiring building modifications and one met its end in a Trump property bankruptcy.  When a disabled Purple Heart veteran filed a lawsuit in 2004 alleging that the Trump International Hotel and Tower in New York lacked proper handicapped-accessible emergency exits, guest rooms and restrooms, Trump dragged the case out for three years. He tried to get the lawsuit dismissed and counter-sued his own architects to try and shift liability to them, but a judge dismissed that attempt. Trump eventually settled and agreed to make changes to the hotel.” [HuffPost]

TRUMP NOT EXACTLY DOING BIGLY IN AMERICA’S MOSQUES  - Donald Akbar. Tim Mak: “Donald Trump’s campaign has begun to make quiet attempts to make amends with the American Muslim community. In September, representatives from his campaign reached out to mosques in Illinois and Virginia, Muslim community leaders tell The Daily Beast, with hopes of speaking to their congregations. They said no to the photo-op—but said they remain in negotiations with the campaign to meet with him privately…earlier this month, Stephanie Holderfield, the Illinois State Director for the Trump campaign, reached out to the Mosque Foundation in Bridgeview, Ill. She was interested in whether Trump could appear publicly before their congregation on Sept. 12, says the mosque’s president, Oussama Jammal. The day was during Eid-al-Adha, a major Islamic celebration, when 20,000 American Muslim would gather at a stadium to pray in the morning. Its leaders rejected the idea outright, both because it was an Islamic holiday and because they didn’t want to give Trump a stage, but said they were open to a private meeting between local Muslim leaders and the Republican nominee.” [Daily Beast]

Trump briefly acknowledged on Friday, Sept. 16, that Obama was born in the U.S., a fact long clear to anyone who was not a fringe conspiracy theorist. He did so that morning only after promoting his new Washington, D.C., hotel and ceding the microphone to a stream of veterans praising him ― a spectacle the cable networks carried for more than 20 minutes before any actual news was made.” [HuffPost]

The crowd was there to get photos taken in front of the gold-lettered Trump name above the entrance; they didn’t appear to be in the market for $ 500-a-night hotel rooms. And that’s the wider problem for Trump: A large chunk of his business depends on filling those rooms, charging golfers thousands of dollars a year in membership fees and selling multimillion dollar apartments. My Stepmom Died And That’s Not Okay

I’ve been having some health problems.

In order to resolve them, I did what any good adult would do: I went to the doctor. It turns out, I’m stressed. I’m stressed in the kind of way that makes your eye twitch for no apparent reason and makes you cry when you drop your fork on the ground (it had one last bite of broccoli on it, okay?).

My doctor asked me about my life and what I have experienced in the last year. I droned on about my engagement (yay!), moving to a new city, planning a wedding, financial troubles, health problems, and the passing of my stepmother.

“You said your mother-in-law died?”

“No, my stepmom.”

“Oh. I was about to say…that is awful! Not that losing your stepmother isn’t awful, but…”

My stepmom passed away seven months ago. This is not the first time I have experienced a less-than-sympathetic reaction. This is not the first time I have had to stifle my tears and reciprocate a stranger’s words with a forced smile. Our society has an innate bias towards the word stepmother.

I blame Cinderella. Thanks, Disney.

I have to be honest here: we bickered a lot. She was stubborn. I was stubborn. We fought, but that doesn’t mean that I didn’t love her. It doesn’t mean that it hurt any less when my father called me on that otherwise beautiful Thursday morning and told me she was gone. It doesn’t mean that I didn’t have to dig deeper than I ever thought possible, to find strength I didn’t know I had, to organize a funeral and finalize all of the details so my dad didn’t have to.

I haven’t fully mourned her loss yet. I don’t know if I have it in me to. She has been in my life since I was a tiny human running around with my blanket and sucking my thumb. With my wedding less than two months away, it’s finally starting to hit me that she wont be present. There are certain things that have always meant more to me when she would say them. Hearing her tell me that I’m beautiful has always been one of them. I don’t know why. Maybe it’s because you expect your biological parents to tell you you’re beautiful. Maybe it means something different when it comes from a “step.” Knowing that I wont hear those words from her on that day stings. It stings the way a stranger’s words sting when they assume I’m fine because I only lost a stepparent. I was only her stepdaughter.

The loss of a stepparent is confusing. Sometimes I feel guilty. Sometimes I feel angry. Sometimes I feel like I shouldn’t be allowed to feel sad because she wasn’t actually my mom. Sometimes I feel like I’m betraying my actual mom by feeling sad.

And, what may be the worst of all feelings, sometimes I feel like I don’t get to feel sad because at times we simply didn’t get along.

I know I’m not the only one who has experienced (or is experiencing) something similar. I know I’m not the only stepchild who has experienced this kind of a loss. I want to change the narrative. I want people to understand the complex range of emotions that can accompany the death of a stepparent when both biological parents are still very active in a child’s (or adult’s) life.

I am blessed. I have an amazing mom and I have a phenomenal dad. I also have a kick-ass stepfather whom I love dearly. Just because I have all of these things, that doesn’t mean that my stepmother’s death should be diluted. I am not deserving of less time to grieve or less time to process what happened simply because my bio parents are amazing.

What I am deserving of is a little bit of compassion.

It has been seven months.

And I think I have finally started to grieve.

Why Being Beautiful and Being a Jerk Seem to Go Hand in Hand

The world is full of neatly drawn divisions: cat people and dog people, brooders and blurters, people whose mental health depends on maintaining inbox zero and people who couldn’t care less. And in the dating world, unfortunately, those two categories often seem to be (a) people who are perfectly pleasant, but whom you find unattractive, and (b) the good-looking ones with terrible personalities. Everyone beautiful is also kind of a jerk.

But as this ASAP Science video (recently highlighted on Motherboard) explained, being beautiful doesn’t make you meaner (and and being mean doesn’t make you seem hotter, for that matter) — the seeming connection between the two traits has more to do with your own skewed impression than it does the actual state of the dating pool.

To understand why, assume that you can divide all your potential mates into four rough quadrants, based on your subjective preferences and impressions: People who are attractive and nice, attractive but mean, ugly but nice, or both ugly and mean. Right off the bat, you can eliminate that last quadrant. The rest, the video explains, just logically flows from there:

Now, 100 percent of the people who are left in your pool who aren’t that attractive to you are nice — they have to be, otherwise you wouldn’t be paying any attention. After all, if somebody is nice, you’re less likely to be critical of their appearance, which brings down the average of nice people’s looks. To the same token, almost half of the people that are beautiful to you are mean. Again, if somebody is really mean, you likely require that they be really attractive for you to give them any attention, which makes it seem like more attractive people are jerks.

Meanwhile, eligible residents of the most appealing quadrant — the good-looking ones with personalities to match — will be a little sparser, since presumably they’re the most in demand. Which, in turn, ups the odds that a date will fall into one of those other two categories: Either the homelier nice ones or, yes, the beautiful jerks. What seems like a cruel prank from the dating gods, in other words, really just boils down to perception. It’s not the field; it’s that you’re looking at the field a certain way.

Kim Davis’s Anti-Gay Views Might Cost Her County Big Time

Just last fall, Kim Davis was at the epicenter of national debate. Despite a brief jail stay, the Kentucky county clerk steadfastly refused to issue same-sex marriage licenses, making her the darling of right-wing conservatives like former Republican presidential hopefuls Ted Cruz and Mike Huckabee

One year later, Davis’s story seems a bit old hat, particularly at a time when the U.S. presidential election is dominating the headlines. But if one legal advocacy group has its way, we haven’t heard the last of Davis yet.

On Monday, the American Civil Liberties Union (ACLU) of Kentucky filed a motion in federal court asking for $ 233,058 to cover attorney’s fees and other legal expenses incurred during the lawsuit it brought last year on behalf of four couples ― two of whom are same-sex, while the other two are opposite sex― when Davis was refusing to issue marriage licenses despite the U.S. Supreme Court’s June 2015 ruling on same-sex marriage.

William Sharp, who is the ACLU’s legal director, said in a press release that his organization aimed “to send a message to government officials that willful violations of individuals’ rights will be costly” by filing the motion, which named both Davis and Rowan County, where she presides, as defendants.

ACLU Ryan Karerat told BuzzFeed News that “the motion does not call for Davis to personally pay the fees,” and as such, Rowan County would likely be liable to pay up. But that didn’t stop her attorney, Mathew Staver, from dismissing it as a “hail Mary” move. Given that marriage licenses no longer include a clerk’s name and title, Staver believes the case is settled. 

“When you file a case and you ultimately are not the victor or the case is muted as in this case especially in favor of the defendant that you sued, there’s no entitlement to attorneys fees under those circumstances,” Staver told local ABC affiliate WTVQ

Whether or not Rowan County ends up having to pay for the Davis debacle, seeing the clerk’s views on same-sex marriage becoming quickly obsolete is perhaps the best comeuppance of all.

I spent a good 12 hours yesterday in front of my laptop monitor. I didn’t plan to go that long, but hey, life happens, and things need to get done. The upside: I got a ton of things done. The downside: my eyes were seriously strained at the end of the day.

When I went to bed last night, still feeling the burn, so to speak, I got to thinking about how much we take our peepers for granted. I mean, how much do we really know about them, apart from the fact we use them to see and they come in a variety of cool colors? And so today, I scoured the web to compile a list of pretty fascinating eye trivia. Let’s get our learn on!

Our eyes have two million working parts, seven million cones which help us see colour and detail, plus 100 million cells (a.k.a. rods) that provide our night vision.

The average blink lasts for about 1/10th of a second.

A key reason eyes become tired at the computer: we blink less often. (Lesson learned.) And yes, sometimes a good nap can help.

80% of all human memories are determined by what we see.

Eyes are the body’s second most complex organ after the brain.

One reason we may never make it to Mars: long-term space travel can wreaking havoc on astronoauts’ eyes.

Eye color is determined by the amount of melanin in your iris.

America Strong

I’m not a fan of Trump. Like many people, I view him as a narcissistic, shallow bigot – an egotist, a con man, a born liar and exaggerator: a bankrupt Houdini of real estate who belongs in jail for felonies like his “university” rather than a comfortable bed in the White House.

And yet… It’s extraordinary. The media doesn’t love him, but it sure as hell gloms on to him! He’s compulsively watchable as he slips his chains of decorum and reason. He’s not a Hitler – who had at least served in combat and knew about bloodletting for real, not as a fantasy game. But Trump’s banter – his conversational style, like a regular guy in the bar who begs attention for his boasts, his braggadocio and wild stories: his banter becomes addictive viewing. It’s like watching one’s favorite villain in a soap. Every day the same, and yet different.

Difficult, though, to imagine millions of Americans casting an actual vote for him as our commander in chief. Were it not for La Hillary.

How Hillary has managed to achieve the opposite – has cleared the bar instead of filling it – is a puzzle. Eight years ago it looked as if the women of America would, almost on their own, elect her their presidential nominee, so distinguished did she seem as a U.S. Senator and former First Lady. But now? Despite her subsequent accomplishments as U.S. Secretary of State on a global stage, she struggles against a tide of disaffection and distrust at home, fanned by those who hate her – even women! They don’t like her schoolmarm-y voice, or her diminutive pantsuit style – or at least they don’t like them enough to have her on twice. She doesn’t play the saxophone, as her husband did, or gush. She has no story that connects with us or our aspirations beyond incremental improvements in our lives, and a steady hand – one that might not be so steady, healthwise.

So for those of us who are Democrats down to our bootstraps: que faire? How change the frog into a princess – and can it be done in time?

Seven weeks to go!

One way comes to mind, as I hear of bombings in Manhattan and stabbings in Minnesota: a Clinton Team.

Hillary, alone, hasn’t the chutzpah, the energy, the political vision to marshal and inspire the collective spirit of America at this critical hour, facing the catastrophe of an ignoramus (in my view) posing as a leader of the right. So Hillary must, late in the day transform herself into Hillary the Team Leader.

America Strong: surely that must be her mantra in the wake of these latest bombings and threats to our democracy. America Strong – Stronger Together: just as, after the Marathon bombings, the people of Boston pulled together, refusing to give into collective hysteria or punitive grandstanding, but silently went about our business, mending the wounds to our community, and making sure life – moral life as well as economic life – went on, and justice was served in an exemplary trial, so that the world would see our values were unshaken.

America Strong: that surely must be a clarion call in these final weeks. Not Hillary the Lone Star Rider, the victim of every barb and homemade verbal bomb that Trumpers delight in throwing, but Hillary the Team Player. Hillary surrounded by men and women willing and anxious to work with her to make our country stronger – in environmental terms, in minimum wage levels, in more equitable taxation, in opportunities for students to learn without going bankrupt (or bankrupting their parents and grandparents); and above all, facing the many crises that will confront us in the coming years, from domestic threats to those abroad; from Isis to al Qaeda, Syria to North Korea, Russia to China.

Clinton as Team Leader, traveling with others as FDR once did on his campaign train, as a figure able to harness the collective energies of a future administration to keep American strong – stronger together.

More faces, in other words – more Americans we know and can trust as a team to do the right thing for our nation – rather than a rich man working for himself and his ego.

Team Clinton. Kaine, Kerry, Kennedy; Warren and Webb, Booker and Brown, Biden and Gore, McCauliffe and Manchin, Nelson and Nixon, Sanders and Wolf…

Not just teamwork but The Team. The Magnificent Seven, Eight, Ten, Ten Thousand – Tens of Millions of Us Americans. America Strong!

There will be more bombings – as in Europe. There are no magical solutions, whether walls or invective or incarceration. The bombers will most often be already among us, fueled by hate and psychopathia.

America Strong, then – America as a team. Not waiting for Houdini’s next trick, but working and relying on each other as Americans – as combatants do in the military, as first responders, as we do in sport.

Team Clinton – not Lone Hillary. And it’s not too late!

Famed Target Cashier Gets A Big Reward For His Viral Act Of Kindness

Earlier this year, Ishmael Gilbert was working as a cashier at his local Target when an elderly woman entered his check-out line. As Gilbert rang up the women’s items, she pulled out a bunch of coins to pay for each item, separately, in change.

Standing behind the woman was a busy working mom named Sarah Bigler, who admits that her initial reaction was irritation. Realizing she was holding up the line, the older woman became flustered and embarrassed. But her cashier, Gilbert, immediately reassured her, dismissing the woman’s apologies and patiently helping her count her coins.

Bigler, who was with her two young children at the time, then experienced a shift in perspective as she watched Gilbert treat the elderly woman with compassion. She snapped a photo of Gilbert doing his job and posted it on Facebook, praising his kindness.

The story soon went viral, and Gilbert found himself at the center of the media’s attention. As he tells SuperSoul.tv in a follow-up interview, he truly didn’t think he had done anything special when he helped the elderly woman. 

“I just treated her, really, like she was my grandma, to be honest,” Gilbert says. “She’s not the fastest, [but] I’m not going to huff and puff and make her feel even more frustrated. I just helped her out and actually seen a smile on her face. So, that was the best part about it.”

Once the initial attention subsided and the news crews dispersed, Gilbert went back to doing his job just as before ― albeit with a little more of a fan base. “People from other states started coming in, just to shake hands and take pictures,” he says.

One person who ended up coming into that Target was the manager of a local dialysis center. But she didn’t want a picture with Gilbert; she wanted to offer him a job.

“I was helping out, once again, another customer,” Gilbert says. “[The dialysis center manager] saw me do the same thing also, and when she came to my line, she was like, ‘Hey, I like what you just did with her. That’s really good customer service.’”

That woman gave Gilbert her card and asked him to call her. When he did, the two talked about an open position working with patients at the dialysis center, and Gilbert agreed to go in for an interview. On the interview, she had Gilbert talk to other managers about his viral story and how he approaches his customers. “They said that they can really use that at the clinic,” Gilbert says.

The 20-year-old father now works at Fresenius Medical Care as a patient care technician and is working toward becoming a certified hemodialysis technician. The center is also paying for his education as he studies to become a registered nurse.

“It’s been going great,” Gilbert says of his new job. “When blessings come my way, I say sometimes it’s not always good to ask why. Sometimes, just take them as they come.”

Make Your Life Better by Saying Thank You in These 7 Situations

I don’t say “Thank You” as often as I should and I doubt I’m the only one.

In fact, I’m starting to believe that “Thank You” is the most under-appreciated and under-used phrase on the planet. It is appropriate in nearly any situation and it is a better response than most of the things we say. Let’s cover 7 common situations when we say all sorts of things, but should say “Thank You” instead. [1]

Say Thank You

1. When you’re receiving a compliment.

We often ruin compliments by devaluing the statement or acting overly humble. Internally, you might think this prevents you from appearing arrogant or smug.

The problem is that by deflecting the praise of a genuine compliment, you don’t acknowledge the person who was nice enough to say something. Simply saying “Thank You” fully acknowledges the person who made the compliment and allows you to enjoy the moment as well.

Example: “Your dress looks great.”

  • Instead of: “Oh, this old thing? I’ve had it for years.”
  • Try saying: “Thank you. I’m glad you like it.”

Example: “Wow! 20 points tonight. You played really well in the game.”

  • Instead of: “Yeah, but I missed that wide-open shot in the 3rd quarter.”
  • Try saying: “Thank you. It was a good night.”

Example: “You killed your presentation today!”

  • Instead of: “Did I? I felt so nervous up there. I’m glad it looked alright.”
  • Try saying: “Thank you. I’m happy it went well.”

There is something empowering about fully accepting a compliment. When you deflect praise, you can’t really own it. When you just say “Thank You,” you let the weight of the compliment sink in and become yours. Saying “Thank You” gives your mind permission to be built up by the compliments you receive.

Getting compliments should be fun and enjoyable, but we often ruin the experience. There’s no need to sabotage compliments that come your way. Accept them with grace and enjoy the moment.[2]

2. When you’re running late.

Being late is the worst. It’s stressful for the person who is running late and it’s disrespectful to the person who is waiting.

It might seem strange to thank someone for dealing with your hassle, but that’s exactly the correct response. Most people stumble in the door and say, “Sorry I’m late.”

The problem is this response still makes the situation about you. Sorry, I’m late. Saying “Thank You” turns the tables and acknowledges the sacrifice the other person made by waiting. Thank you for waiting. [3]

Example: You walk in the door 14 minutes late.

  • Instead of: “So sorry I’m late. Traffic was insane out there.”
  • Try saying: “Thank you for your patience.”

When we make a mistake, someone else often makes a sacrifice. Our default response is to apologize for our failure, but the better approach is to praise their patience and loyalty. Thank them for what they did despite your error.

3. When you’re comforting someone.

When someone comes to you with bad news, it can be awkward. You want to be a good friend, but most people don’t know what to say. I know I’ve felt that way before.

Often times, we think it’s a good idea to add a silver lining to the problem. “Well, at least you have…”

What we fail to realize is that it doesn’t matter if you don’t know what to say. All you really need is to be present and thank them for trusting you.

Example: Your co-worker’s mother passed away recently.

  • Instead of: “At least you have a lot of fond memories to hold onto.”
  • Try saying: “Thank you for sharing that with me. I know this is a hard time for you.”

Example: Your brother lost his job.

  • Instead of: “At least you have your health.”
  • Try saying: “Thank you for sharing this with me. I’m here to support you.”

Example: Your friend’s pet just died.

  • Instead of: “At least they had a long and happy life.”
  • Try saying: “Thank you for sharing that with me. I’m here for you.”

In times of suffering, we don’t need to hear words to ease the pain as much as we need someone to share our pain. When you don’t know what to say, just say “Thank You” and be there.

4. When you’re receiving helpful feedback.

Feedback can be very helpful, but we rarely see it that way. Whether it is an unflattering performance review from your boss or an email from an unhappy customer, the standard reaction is to get defensive. That’s a shame because the correct response is to simply say, “Thank You” and use the information to improve.

Example: “This work isn’t good enough. I thought you would do better.”

  • Instead of: “You don’t understand. Here’s what really happened.”
  • Try saying: “Thank you for expecting more of me.”

Example: “I bought your product last week and it already broke. I am not happy with this experience.”

  • Instead of: “How did you use it? We made it very clear in our terms and conditions that the product is not designed to work in certain conditions.
  • Try saying: “Thank you for sharing your thoughts. Please know we are committed to becoming better. Can you share more details about the issue?”

Nobody likes to fail, but failure is just a data point. Respond to helpful feedback with thanks and use it to become better. [4]

5. When you’re receiving unfair criticism.

Sometimes criticism isn’t helpful at all. It’s just vindictive and mean. I’ve written about how to deal with haters previously, but one of the best approaches is to just say thank you and move on.

When you thank someone for criticizing you, it immediately neutralizes the power of their statements. If it’s not a big deal to you, then it can’t grow into a larger argument.

Example: “This might be good advice for beginners, but anyone who knows what they are doing will find this useless.”

  • Instead of: “Well, clearly, I wrote this for beginners. This might be a surprise, but not everything was written with you in mind.”
  • Try saying: “Thank you for sharing your opinion. I’ll try to improve next time.”

Example: “Your statement is the dumbest thing I’ve read all week.”

  • Instead of: “You’re an idiot. Let me tell you why…”
  • Try saying: “Thank you for the feedback. I still have a lot to learn.”

Releasing the need to win every argument is a sign of maturity. Someone on the internet said something wrong? So what. Win the argument by the way you live your life.

6. When someone gives you unsolicited advice.

This shows up a lot in the gym. Everybody has an opinion about what your technique should look like. I think most people are just trying to be helpful, but hearing someone’s opinion about you when you didn’t ask for it can be annoying.

One time, someone pointed out some flaws in my squat technique in a video I posted online. I responded by sarcastically asking if he had a video of himself doing it correctly. Somewhere deep in my mind, I assumed that if I reminded him that his technique wasn’t perfect, then I would feel better about the fact that mine wasn’t perfect either. That’s an unnecessary and defensive response.

The better approach? Just say “Thank You.”

Example: “You know, you should really keep your hips back when you do that exercise.”

  • Instead of: “Oh really? Do you have a video of yourself doing it so I can see it done correctly?”
  • Try saying: “Thank you for the help.”

Pointing out others faults doesn’t remove your own. Thank people for raising your self-awareness, even if it was unsolicited.

7. When you’re not sure if you should thank someone.

When in doubt, just say thank you. There is no downside. Are you honestly worried about showing too much gratitude to the people in your life?

“Should I send a Thank You card in this situation?” Yes, you should.

“Should I tip him?” If you don’t, at least say thank you.

Say thank you, more often.

CNN Chief Jeff Zucker Defends Hiring Ex-Trump Campaign Manager Corey Lewandowski

NEW YORK ― CNN chief Jeff Zucker defended the hiring of former Donald Trump campaign manager Corey Lewandowski at a Tuesday town hall, telling employees that the network needed to bring in voices supportive of the Republican nominee to balance its commentary ranks, according to network sources.

The June 23 hiring of Lewandowski rankled journalists inside and outside CNN given the former campaign manager’s seeming disdain for the press. In addition to overseeing a media blacklist, Lewandowski grabbed reporter Michelle Fields, now with The Huffington Post, and reportedly pushed CNN correspondent Noah Gray. He also once threatened to blacklist Gray for leaving the “press pen” at an event.

Lewandowski, who presumably can’t speak candidly about the Trump campaign due to a non-disclosure agreement, was flowing with praise for his former boss right out of the gate.

In mid-July, CNN began to disclose that Lewandowski was still receiving severance from the Trump campaign during his on-air appearances, though the network didn’t explain why it began doing so then. 

At Tuesday’s town hall, Zucker said the network was aware of Lewandowski’s severance from the start of his employment.

CNN spokespeople did not immediately provide comment on questions about Zucker’s remarks. 

It was revealed last month that Lewandowski’s firm received its normal $ 20,000 consulting fee from the Trump campaign on July 6, again driving conflict of interest questions for the network. Lewandowski also reportedly is still informally advising the campaign while commenting on it for CNN.

Zucker has a long history with Trump given that he ran NBC during the launch of Trump’s reality show “The Apprentice.” The veteran TV executive faced criticism early in the 2016 election for the attention CNN paid to Trump, who now rarely appears on the network and routinely bashes it as favoring Hillary Clinton. 

CNN, which already employed several prominent conservative commentators, added several pro-Trump pundits this cycle, including Jeffrey Lord, Kayleigh McEnany and Scottie Nell Hughes. Zucker publicly praised Lewandowski as having “done a really nice job” in an August interview that ran the same day the Republican operative revived Trump’s toxic birtherism

CNN host Jake Tapper, who moderated Tuesday’s employee town hall, also emphasized that many of the network’s stable of conservative pundits were Trump critics and that it’s important to have people on air representing the views of the tens of millions of Americans expected to vote for the Republican nominee.

Tapper pointed out that CNN is in a unique position when it comes to providing balance, as opposed to Fox News and MSNBC, cable channels with partisan leanings, and broadcast networks that aren’t covering news round-the-clock on television.

Embracing The Seasons

Pumpkin pie spice lattes, boots, rakes, hoodies, and long yoga pants announce this time of the year. In September where I live, I need the heater in the morning and the air conditioning in the afternoon; in October the nights are cold and the garden begins its slumber. I love summer’s pizazz, but by the time fall blows in, the autumn colors take second to none.

There’s something extraordinary about every turn of the globe. Much like our lives, we can mourn the passing of each season of our lives or applaud the adventure of the new span of time.

As I pluck the pumpkins from our garden to decorate the front porch, I remember not only the time I carved my first gourd, but I can still recall when our pre-schoolers struggled hopefully under the weight of their first pumpkins. I miss those days, but the cool weather brings them home to the fire pit in the front yard where they share the struggles and adventures of being adults now. I love this time of life where they spend time with us because they want to rather than because they’re grounded! Both spells of time are precious.

And like the changing seasons and maturing trees, our lives progress to new heights and depths. We grow deep roots, and sturdy branches and survive the storms and springs. And as we mature, like the trees we plant, we provide shade and rest for those that come behind us. It’s so much fun celebrating those arriving into the spring of their lives, applauding the efforts and mistakes of those in the summer of their existence. It feels a bit strange and yet comforting to find us in the fall of our earthly residence. But rather than look back over my shoulder, I think instead I’ll find the golden nuggets of this portion of my life’s cycle. It takes storms, weeds, sunshine and slugs to teach plants to stand strong against nature’s destruction. Likewise, the rough stuff life throws at us makes us tougher, wiser, resilient, and prosperous.

Like the arrival of autumn, time marches on and we can moan about the good ole days or embrace the adventures to come. Today I think I’ll decorate the porch with autumn’s abundance, and go share a pumpkin spice latte with friends.

Sipping Sake For Health

I don’t know what I like more about sake… I could say the taste, flavor or the sensation of it in my mouth but let’s be honest, I love the feeling of being a giant with those tiny cups. It’s like a tea party for adults. When studying food culture and health, we see a relationship between libations and health. However, it was just drunken ranting until now. To my delight, someone has done some pretty good research on this and opened the door to what I already knew: moderate drinkers are healthier. I recently attended a lecture at Harvard University’s Healthy Plates, Healthy Lives conference and listened to Dr. Eric Rimm extol the virtues of alcohol, which include: increase in HDL (good) cholesterol, an increase in insulin sensitivity, and a decrease in inflammation.

With this knowledge in hand, I feel it is my duty to bring all of you some new and noteworthy alcohol options you may not have tried. This past Friday, I had the chance to visit The Joy of Sake in New York for its 11th annual celebration. This event was the largest sake tasting in the world, outside of Japan, and the cups may have been petite but the interest was enormous. The place was packed with foodies sampling the widest variety of sake I had ever seen. They presented over 400 premium sakes with appetizers to match the theme. From En Japanese Brasserie, serving up torotaku, which is fresh tuna belly tartare in a nori wrap, to SushiSamba’s offering of yellowtail tiradito with avocado, pickled red cabbage, crispy wonton skin and aji amarillo, amazing treats to tempt your taste buds lined the hall. A few of my favorite sake samples were Zipang Sparking Sake and Kamoizumi Shusen Junmai Ginjo better known as “Three Dots”. Sake, like wine, is about finding the bottle that speaks to you, however, there are some guidelines for doing sake right:

Portion Your Pour. Although alcohol may benefit your health, stick to the right amount and be sure to drink in moderation. I see many of my patients abstain from drinking Monday through Friday only to run wild on the weekend. The idea is that it is not only the amount you drink but also when you drink it. According to the research for women, it’s one drink every other day, and for men, it’s one to two drinks every other day. This produces an effect in the body called hormesis, which is something that harms you a little bit, like alcohol, but your body responds by becoming stronger. So, it is still unrealistic to binge on a whole bottle of whiskey and expect wellness.

Make It A Social Activity. The aspect of drinking I feel is quite important but so often overlooked is the comfort of sharing a dining and drinking experience with others. Eating and drinking alone is strongly associated with depression, which can cause a whole host of problems; sharing a meal and drink can make you and others feel better, which can decrease blood pressure and help you to relax.

Pair It With Asian-ish Menus. Creating your menus to be more pan-Asian allows you to include elements that are often left out of American menus. From seaweed to miso, adding one new ingredient, like sake, opens the doors to many others with healthful benefits. As Americans, we are always mixing and playing with food cultures anyways, why not be open to the idea of including sake in your beer, wine, and whiskey repertoire. I mean, we came up with the sushi burrito didn’t we? Who knows what we will eat next.

Finding the balance in drinking for pleasure and health may seem like a new concept. But I assure you that if you merge the two ideas, it will allow you to maintain a wholesome life because being healthy isn’t all about your body but also your soul.

Be Fearless, Be Full.

Teen Was Fleeing Police When Fatally Shot, Forensic Report Finds

A forensic report released on Monday by attorneys representing the family of a 13-year old African American boy fatally shot by a white Columbus, Ohio, police officer last week said the teenager was shot three times while running away.

Francisco Diaz, a Michigan medical examiner hired by the family’s attorneys, on Sunday examined the body of Tyre King. According to the Columbus Police Department, he was shot multiple times after he appeared to pull a handgun from his waistband during an encounter with police after a report of an armed robbery.

It was later determined the gun in question was an air pistol that fires BBs – small, metal pellets, not bullets. Columbus Mayor Andrew Ginther previously said the BB gun looks “almost identical” to the 9-millimeter Glock semi-automatic handguns carried by city police.

“Based on the location and the direction of the wound paths, it is more likely than not that Tyre King was in the process of running away from the shooter or shooters when he suffered all three gunshot wounds,” Diaz said, according to a statement from attorneys Sean Walton and Chanda Brown.

City officials referred calls to the Franklin County Coroner’s Office, which said it had not provided any information to Diaz and a determination on the cause and manner of King’s death was pending.

Attorneys for King’s family said the coroner’s office has completed the autopsy and told the family the results will not be available for six to eight weeks. The family has called for an independent investigation of the shooting.

Diaz described King as a “small-framed adolescent boy,” who was 5-feet tall and weighed less than 100 pounds. He found the boy “suffered three gunshot wounds with entrance paths on the left side of his body, any of which could be determined to have been the cause of death,” the attorneys said.

On Saturday, Columbus police arrested Demetrius Emanuel Lee Braxton, 19, in connection with the reported robbery preceding King’s shooting. Braxton was charged with one count of robbery.

Braxton and King were two of three suspects police confronted after responding to reports of an armed robbery. Police are still looking for other individuals who might have been with Braxton at the time of the robbery.

King’s family members said last week the version of events related by officer Bryan Mason, the nine-year veteran who shot King and has been placed on administrative leave, conflicted with witnesses’ accounts.

Progressive group Organize Ohio planned a rally on Monday at Columbus City Hall demanding justice for King.

Once, alchemists sought the secret formula for turning lead into gold. Nowadays, we seek things that are rather more unattainable. The perfect job. The perfect relationship. The perfect family life. Perfect health. Perfect everything!


Our Automatic Approach

Sam, for instance, tries to get the perfect body. His diet is whatever TV says is the latest “right way.” He exercises however his Facebook feed says is “the best way it’s done” (which is it again: cardio or strength?).

However, it’s hard to keep good habits; mostly Sam just tries until he fails (which is often).

When Sam was a student, he studied the one way he knew how. He picked his major, his profession, his job based on advice from his parents, with just a few moments reflecting on his own desires or how to do the most good with his career. Medical treatment? He gets whatever he hears is best according to hearsay and best friends.

You probably don’t need me to tell you how that’s working for Sam. Sometimes things go well, sometimes they don’t, more or less at random. Things just…happen to Sam; he rarely feels in control.

Sam lives his life on autopilot. And he sometimes wonders if this is really the best he can do.

For that, I admire Sam. He has a sense that there’s a better way, that he himself can do better. He’s self-aware, seeing that his “any ole’ way” strategy isn’t working for him. Realizing that if you’re lacking results, you must be lacking…something important… is the first great key.

A golden life needs a silver bullet. Without it, for all his admirable drive to improve his life, all his energy, I fear Sam will just move from one not-very-impressive strategy to another. Life often fails to reward our effort, if that effort is not properly directed.

What approach can make us powerful, succeeding in every area of life? You might have heard it before:
Seek the truth all the days of your life
And “the truth will set you free.”

The Rational Approach

Unlike Sam, Sally seeks the truth. She looks on a mess of a thousand lies and plucks the one nugget of truth out of it. She grows more powerful as the years pass; the diamonds in the rough inevitably end up in her hands; others may be satisfied by fool’s gold, but her kind want the genuine article, and they get it.

Results. Sally’s work is rewarded with results. She sifts through diet advice and finds what really works. Changing habits isn’t easy for anybody, but Sally figured out how to make that work for her, too. Her exercise plan works. She has a feeling of control in her life. She knows exactly why she chose what to study and the work she wants to do. The truth has served her well.

The star’s natural state is to shine surrounded by darkness on every side. Truth’s natural state is to shine amid frustrated, useless lies on every side. The truth-seeker’s natural state is to succeed on every side, while others ask “What’s your secret?” Sally’s secret is not assuming that she holds the truth, but to keep checking whether what she believes is true, and how well her beliefs enable her to accomplish her goals.

It’s so tempting to believe that we have the truth, isn’t it? Who would admit otherwise? Indeed, anyone you ask will be willing to tell you the way to success.

Fake Answers

If we want to get to New York, which is worse, having no map, or following a map to Congo? The answer is even more obvious when maps to New York are right there for the taking, but we’re not taking them because we “already have our map.”

This is why seeking the truth is only a first step. What if we just fall for the most convincing fake “truth” on the market?

Nate Silver, enjoying incredible success in his work of predicting the future, wrote a book called The Signal and the Noise¸ all about how to find the true “signal” (the truth) when it’s cut up in a thousand pieces and hidden, scattered in “The Noise” (fake answers). This is our second great key, finding the answer. Not just finding an answer, finding the answer, the truth.

These are the two great trials in life, the two gates on the road to success. First, asking the question, and second, finding the (right) answer. Finding our ignorance, then finding its cure. Starting a quest for truth, then resisting the siren call of fake answers.

Rationality is Results

What will happen when Sam learns to find the signal, the lighthouse in the distance, the guiding star, instead of going from one noise to the next?

He will succeed. He will move from one area of his life to the next, finding the useful tricks out of the useless, each adding to his chest of knowledge like precious gemstones. One area of his life after another will shine like the sun, as Sam himself begins to, one struggle after another defeated and trophied, a victory to be rightly proud of.

This is called rationality, of the real kind. Rationality is about results. And results come from finding the one path that leads upwards out of a thousand confused paths going nowhere.

Why rationality? Why not just be satisfied with what we’ve got, never looking for a better way to study, to work, to make decisions, to parent, or date, or get in shape, or get our life in shape? Why not be be satisfied with whatever answer we picked up along the way, and be satisfied with the results our efforts give us?

Then again, why shouldn’t you succeed? Don’t you want to stride through life, growing stronger by the day? Why shouldn’t you go from one area of life to the next, becoming healthier, happier, more capable, more successful, more anything you want?

There is a way. But there is also a cost.

The Cost

Can you lift your head up and search the stars? Can you admit that you have to look if you’re going to succeed?

Even if you pass this test, there is a second. Can you admit that if you didn’t spy the right answer the first time, you might not spy it the second? That you need to learn how to judge truth from error? Can you accept it if the truth isn’t what you thought it was, what you hoped it was?

If so…Then I repeat, there are answers.

Conclusion

Remember, the first great trial is realizing you have to look for answers. The obvious thing is to look for answers where you have none. But far more subtle (and difficult) is the need to look for answers where you already have some, but need to ask, “Am I letting a made-up map keep me from looking for a genuine one?”

And the second great trial is to become discerning, to get the right answer. To see a palace of glass and find the diamonds hidden in plain sight. To view the waving, warping kaleidoscope of fanciful ideas and see through their distraction to the truth. The signal amid the noise. Seek truth all the days of your life, and the truth will give you power to set yourself free. Be rational. Those who seek the stars for a lifetime, one day become stars themselves.

  • Why do people say “knowledge is power?”
  • Why do we sometimes feel certain about things, only to later find out we were mistaken?

Are Head Transplants Possible… and Ethical?

During a cold, dreary summer in Switzerland 200 years ago, English author Mary Shelley sat down to write her novel “Frankenstein.”

The story — and subsequent adaptations for the screen — has gripped our imaginations ever since.

While reanimating the dead remains a scientific impossibility, scientists are pushing the boundaries of modern medicine closer and closer to Shelley’s vision.

As they do, the public’s uneasiness about the ethical limits of medicine has been stoked.

Take, for example, the announcement last year by Italian neuroscientist Dr. Sergio Canavero that he plans to perform the first human head transplant.

Not sometime in the distant future … but possibly in 2017.

And now he has a volunteer for the procedure — Valery Spiridonov, a 31-year-old Russian man with a degenerative muscle condition.

This has bumped Canavero’s bold plans from the realm of science fiction straight into the real world.

Like Victor Frankenstein, Canavero hopes to make great scientific advances, even if it means working at the fringes of modern medicine.

For some critics, though, transplanting a human head onto a new body crosses a line — one similar to the line that Shelley’s fictional doctor stepped over when he created his “creature.”

Is a head transplant possible?

Compared to transplanting a heart or kidney, a head transplant is technically much more challenging.

Surgeons will need to join many tissues of the head and new body, including muscles, skin, ligaments, bones, blood vessels, and most importantly, the nerves of the spinal cord.

But there has already been some groundwork laid for the “audacious plan” of Canavero and his partner, Chinese surgeon Dr. Xiaoping Ren, as described in the September issue of The Atlantic.

In the early 1900s, a Missouri surgeon transplanted the head of one dog onto the neck of another, creating one with two heads. This feat was repeated by Soviet and Chinese surgeons in the 1950s, with the dog living for 29 days.

In the 1970s, a surgeon from Ohio transplanted the heads of rhesus monkeys onto new bodies.

They survived and could even eat and follow objects with their eyes. But the doctor hadn’t reconnected their spinal cords, so they remained paralyzed.

Canavero and Ren have different plans.

They hope to fuse the nerves cells of the head and body using a gluelike chemical called polyethylene glycol.

Ren has already tested this chemical on mice with spinal cords that have been severed. The mice were walking within two days of the procedure.

In preparation for Spiridonov’s surgery next year, Ren’s team has also successfully transplanted a mouse’s head onto another body. This was later repeated on a monkey.

These animals, though, were euthanized within a day of the procedure. So future experiments are needed in order to know if a head transplant is a long-term solution.

Extremely risky procedure

According to The Atlantic, Canavero says there is a “90 percent plus” chance of success. Ren, though, is less definite about the outcome.

And as with all transplant surgeries, there are many risks.

Before Patrick Hardison underwent one of the world’s most extensive face transplants, doctors gave him a 50 percent chance of survival.

Infection, loss of blood flow to the transplanted organ, and rejection of the new tissue all lower the odds of success.

With a head transplant, loss of blood flow to the brain is an even larger problem. Lack of oxygen can damage the brain and leave a person with severe mental deficiencies.

Cooling both the head and body before and during surgery could allow the cells to survive longer without oxygen. Still, doctors would only have an hour or less to complete the surgery.

One of the most common risks of organ transplants is tissue rejection. With a head transplant, though, it would be the head that would be seen as “foreign” by the new body’s immune system.

Finding a donor body that is a good match for Spiridonov — in this case a male who died of head trauma with no damage to the body — could minimize this risk.

But he would need to take powerful immunosuppressive medications for the rest of his life to limit the chance that the new body’s immune system would attack the tissues of his head.

After surgery, Spiridonov would be kept in a coma for several weeks to allow his spinal nerves to heal.

But if he wakes up before his spinal nerves heal, there is a chance that he would be paralyzed. Or that his nerve cells would fuse incorrectly — with nerves meant to control the arms connected to the legs instead.

In spite of that, Spiridonov is still willing to face those odds.

His genetic condition, known as Werdnig-Hoffmann disease, has left him confined to a wheelchair.

His movements are limited to typing, feeding himself, and steering his wheelchair with a joystick.
Werdnig-Hoffmann disease is also fatal, although Spiridonov has already lived longer than his doctors had expected.

Crossing an ethical line

The fringe nature of Canavero’s and Ren’s plans has led to harsh backlash from scientists and ethicists.

Some have called it “nuts” or scientifically impossible.

Others are concerned that even though Spiridonov is aware of the risks, it still doesn’t make it OK for doctors to perform the surgery.

And then there is the cost — between $ 10 million and $ 100 million.

Would this money be better spent on helping the thousands of people who suffer spinal cord injuries each year?

Head transplants also raise issues of who the new body belongs to, especially in terms of its sperm or eggs.

If someone with a new body had a child, would the family of the donated body have visitation rights?

And then there are the more philosophical questions. What does it mean for a person’s sense of self to have a body that they weren’t born with?

There’s not even certainty that someone would be able to accept a new body as part of themselves.

The man who underwent the world’s first hand transplant was uncomfortable with his new hand.

So he stopped taking his immunosuppressive drugs and the hand had to be removed.

Public angst about head transplants may subside after a few successful surgeries, the way it has with face transplants.

But for now, Canavero and Ren are still working on the other side of a line that many think we shouldn’t cross.

Supreme Cover-Up: How the Wisconsin Justice System Failed in the Walker John Doe

Recent elections have turned the Wisconsin Supreme Court from “one of the nation’s most respected state tribunals into a disgraceful mess,” wrote noted author on the courts Lincoln Caplan in 2015.

The dysfunction is on full display in the documents revealed by the Guardian this week in its expose on the “John Doe” investigation into potentially illegal coodination between Scott Walker and dark money groups that were supposed to operate independently of his campaign.

John Doe Judge Fails on Expenditure Coordination

The Wisconsin John Doe investigation was started by a bipartisan group of district attorneys and Judge Barbara Kluka who saw sufficient evidence of probable cause to authorize search warrants of Walker’s top aides and a number of dark money groups. But Kluka stepped down and Judge Gregory A. Peterson was appointed. 

The type of high-dollar, high-donor fundraising discussed in this week’s Guardian expose had never happened in Wisconsin before. Yet Peterson quashed the search warrants in 2014 stating in a cursory decision:  

“I am persuaded by Friends of Scott Walker that the statutes do not regulate coordinated fundraising. Only coordinated expenditures may be regulated and the state does not argue coordination of expenditures occurred. Therefore, the subpoenas fail to show probable cause.”

But the documents released by the Guardian this week are replete with evidence of expenditure coordination. 

In concert with federal FEC rules, Wisconsin Government Accountability Board rules at the time stated that there is coordination “where there has been substantial discussion or negotiation between the campaign or the spender over, a communication’s: (1) contents; (2) timing; (3) location, mode, or intended audience (e.g., choice between newspaper or radio advertisement); or (4) ‘volume’ (e.g., number of copies of printed material or frequency of media spots).”

Stacks of emails show that Walker’s top campaign advisor and Wisconsin Club for Growth campaign guru R.J. Johnson approved, placed, and rotated ads in the 2011 Senate recalls, and in the 2011 Supreme Court race on behalf of multiple groups, including WCFG and its offshoot Citizens for Strong America, Wisconsin Manufacturers and Commerce (WMC), Jobs First Coalition (a shell group controlled by AFC’s Scott Jensen, the former Speaker of the Wisconsin Assembly who was brought down by his own campaign finance scandal), Wisconsin Family Action and later in 2012, the American Federation for Children. Emails show R.J. Johnson juggling disclaimers, pulling one name off and slapping another on, approving ad buys and ad placement. The public would see a series of ads from purportedly different groups, but the reality was that R.J. Johnson was behind the shell game orchestrating the air bombardment. 

Scott Walker would boast to Karl Rove on May 4, 2011 “Bottom Line: RJ helps keeps in place a team that is wildly successful in Wisconsin. We are running 9 recall elections and it would be like 9 congressional markets in every market in the state and twin cities.” (emphasis added). (Key-Misc-Set-One, p.16)

In 2012 as the Walker recall approached, prosecutors point to two emails that show R.J. Johnson on both sides of the coordination issue, both dated April 30, 2012. One email has R.J. Johnson approving a final Friends of Scott Walker ad, sending the note “this should be final unless someone has an issue” to Friends of Scott Walker’s Keith Gilkes, WCFG’s Deb Jordahl and others. CMD is not certain what the second email is that prosecutors are referring to, but there is an email dated April 30, 2012, where R.J. Johnson appears to direct Jordahl to spend the last few thousand dollars of WCFG money left over in a vendor’s media account: “we need to get this out, express today if possible,” R.J. Johnson says. (2012-08-14-Exhibits-01-100-PT2, p.47)

Wisconsin Supreme Court Misleads on Express Advocacy

The conservative majority of the Wisconsin Supreme Court was elected with at least $ 10 million in spending by the groups under investigation. Many outside groups outspent the justices themselves. Two justices, Gableman and Prosser, were asked to recuse by prosecutors, but refused.

In 2015, when it shut down the John Doe, the Wisconsin Supreme Court rewrote Wisconsin law in an attempt to legalize coordination between candidates and third party “independent” groups for “issue advocacy.” It is important to note that the court left intact the law’s prohibition on coordination around express advocacy or what is called its “functional equivalent.”  

Express advocacy ads — those that say “vote for” or “vote against” a candidate — are increasingly rare.  Campaign managers learned more than a decade previously that you didn’t need to say the “magic words” to have a devastating impact on an opponent. This is why the U.S. Supreme Court held in 2007 that a communication is the “functional equivalent” of express advocacy “if the ad is susceptible of no reasonable interpretation other than as an appeal to vote for or against a specific candidate.” 

The Wisconsin Supreme Court said in dismissing the John Doe that “the special prosecutor has not alleged any express advocacy.” Yet prosecutors raised express advocacy explicitly in their filing with the court under the hard-to-miss header “Express Advocacy.” (2014-2-21-Schmitz-Affidavit, p. 29)

They explained to the court how big groups like the Republican State Leadership Conference and the Republican Governors Association were in close contact with the Walker campaign. Both groups registered formally as an independent expenditure/express advocacy group with the Wisconsin elections board, and swore an oath saying they would not coordinate with Walker. RGA would spend a whopping $ 9.5 million in the Walker recall race on a barrage of ads that were the functional equivalent of express advocacy. 

Yet, the Supreme Court ignored these facts and when the special prosecutor asked to present more evidence, they fired him. 

Prosecutors alleged that “far from being independent, evidence shows that Johnson coordinated with RSLC on the content of ‘broadcast and cable’ advertising in the 2011 recall elections. Johnson coordinated radio advertising to ‘complement’ the ads RSLC was running in the same 2011 recall races.” 

Prosecutors alleged that “FOSW and its agents were regularly conducting meetings/conference calls with RGA to discuss campaign strategy including polling. Governor Walker conducted phone calls and attended fundraising events coordinated by RGA.” 

Indeed one email from RGA’s Nick Ayers directly to Scott Walker ccing Republican National Committee chair Reince Priebus lays recommends a coordinated battleplan. ”Spoke to Gillespie this morning. My sense is that everyone’s heart (AFP, WIGOP, RSLC, RGA, CFG) is in the right place but no one is clear on the entire battleplan, and that is leaving very vulnerable gaps in both the planning and execution of a winning strategy.” Ayers goes on to layout the battle plan in a key email. (2013-08-29-Schmitz-Affidavit, p 24). Among the groups referenced are the Koch’s Americans for Prosperity and Club for Growth. Ed Gillespie is a key GOP strategist with close ties to Rove who ran the Republican State Leadership Committee at the time. 

The coordination was evident on the expenditure side in the ads. ”Forward–Walker, Backwards–Barrett” was a central theme in Walker campaign ads showing people walking backwards, clocks spinning backwards etc, including this May 7, 2012 ad. Republican Governors Association ads had the same theme, as did adds by WMC-IMC and other smaller groups like Wisconsin Recall Action. 

Many of these ads were the functional equivalent of express advocacy say experts. 

Prosecutors believe Walker raised funds for these WMC-IMC ads and that R.J. Johnson may have been paid for placing them. Investigators say in the filings that bank records reflect wire transfers in April and May 2012 from WMC-IMC to Ten Capitol (the ad firm of WCM) totaling $ 3.7 million. “Coinciding with the wire transfers to Ten Capitol, WMC-IMC received payments from WiCFG” wrote prosecutors. “Consistent with a commission for ad placement, R.J. Johnson and Associates received $ 50,000 from Ten Capitol on June 22, 2012.” 

The Wisconsin Supreme Court held that coordination with groups that run express advocacy ads or its function equivalent was barred, yet the court failed to look at the many ads that qualified as express advocacy or its functional equivalent and fired the special prosecutor when he objected. 

“The miscalculation I made in this investigation was underestimating the power and influence special interest groups have in Wisconsin politics,” said special prosecutor Francis Schmitz at the time, a retired U.S. Army colonel and former counter-terrorism prosecutor.

New Information on Gableman and Prosser Recusal

When prosecutors asked Gableman and Prosser to recuse, some scratched their heads. Why focus on those two when four Justices were elected with massive spending from Wisconsin Club for Growth and Wisconsin Manufacturers and Commerce, two of the groups under investigation?

An email in the stack may answer this question. 

In the same email from Scott Walker  to Karl Rove on May 4, 2011, Walker writes: “RJ was the chief advisor to my campaign. He pulled together the team who flipped the Senate three times and the Assembly two times. He ran the effort that defeat the first incumbent Supreme Court Justice for decade back in 2008 and Club for Growth – Wisconsin was the key to retaining Justice Prosser.” (Key-Misc-Set-One, p.16)

In the 2008 Surpreme Court race Justice Louis Butler was unseated by Michael Gableman in an ugly race that resulted in the state’s judicial commisison filing a formal complaint against Gableman that was left unresolved by the ideological split on the Supreme Court.  Justice Gableman wrote the 2015 court decision shutting down the John Doe. 

These facts are newly relevant as the U.S. Supreme Court is scheduled to take a look at the prosecutors appeal of the John Doe case this month.
